- The Seller undertakes to rectify or, at its sole discretion, replace defective Timepiece(s) free of charge within an agreed time, to be mutually determined from the date of delivery.
- Conditions for Warranty:
- The Buyer must promptly notify the Seller in writing upon discovering a defect.
- The defect must result from faulty design, materials, or workmanship of the Seller.
- Replacement delivery time may be affected by factors beyond the Seller's control, including lead times from the Timepiece(s) manufacturer.
- If requested by the Seller, any Timepiece(s) for rectification or replacement must be returned to the Seller at the Buyer's expense.
2. Third-Party Supplied Timepieces:
- Warranties provided to the Seller by a third party in respect of Timepiece(s) shall be passed on to the Buyer.
3. Warranty Classes:
- Pristine Timepieces:
- Include an International Worldwide Warranty from the manufacturer's authorized dealer or agent. Service and support should be sought from the manufacturer's authorized service centre.
- Pre-Owned Timepieces:
- Warranted by the Seller against mechanical defects or failure for sixty (60) months from the purchase date, subject to terms and conditions.
- Excludes Pre-Owned Customized Bejeweled Timepieces, with warranty terms explicitly detailed in the Official Certificate/Receipt issued at the time of purchase.
- Commission Timepieces:
- Sold "as-is" without warranty. However, the Buyer and Seller may negotiate an in-house warranty independently, if desired.
- The remedies outlined in this Clause do not affect other terms and conditions within the agreement.
4. Limitation of Liability:
- The Seller holds no liability for representations made before the contract, and any liability is limited to the contract price.
- This limitation does not apply to cases of death or personal injury resulting from the Seller's negligence or that of its employees or agents.
5. Cancellation and Termination of the Contract:
- If the Buyer cancels or terminates the contract, payment or a portion thereof shall be forfeited to the Seller.
- For cancelled or terminated Timepiece(s) within the contract, the Seller will refund 50% of the value.
6. Return Policy:
- Timepiece(s) purchased online may be returned under specific circumstances.
- The Seller must be notified of any discrepancies within three (3) working days of receipt.
- The Seller will confirm the acceptance of the return and provide a full refund, excluding reasonable transport and/or dispatch charges, if any.
7. Cancellation Policy:
- The Seller reserves the right to cancel an order under various circumstances, including unavailability, impossibility of delivery, or suspicion of fraud.
- If the Seller cancels an order placed before 5.00 pm Pacific Time on the same day, the Buyer is entitled to a full refund of the Purchase Price or installment already paid.
